Terms of Service

These Terms of Service (“Terms”) govern access to and use of the Fit Pulse application, website, and related services (collectively, the “Service”).

1. Acceptance

Accessing or using the Service constitutes acceptance of these Terms and the Privacy Policy. Discontinue use if you do not agree.

2. Eligibility

Use of the Service requires being at least 13 years of age. Users in the European Union must be at least 16 years of age or have verifiable parental consent. Users represent they meet these requirements.

3. Service Description

Fit Pulse is a personal workout tracking application for logging exercises, managing routines, tracking rest intervals, reviewing history, and viewing analytics. The Service operates in Guest Mode (local data only) or Authenticated Mode (cloud-synced data via third-party authentication).

4. Accounts

Cross-device synchronization requires an account via a third-party authentication provider. Users are responsible for account security and must report unauthorized access. Fit Pulse may suspend or terminate accounts for suspicious activity or violations.

5. Data Ownership

Users retain ownership of all content created through the Service. Fit Pulse receives a limited, non-exclusive, royalty-free license to host, store, process, transmit, and display user content solely to operate the Service. This license ends upon content deletion.

6. Acceptable Use

Prohibited activities include: unauthorized access to other accounts or systems; automated data extraction; uploading malicious code; reverse engineering the Service; harassment; illegal activity; commercial exploitation without consent; and interference with Service integrity or security.

7. Health Disclaimer

The Service provides tracking and analytics only and does not offer medical or fitness advice. Users assume all risks associated with physical exercise and should consult a physician before beginning any program.

8. Availability

The Service is provided “as available.” Fit Pulse does not guarantee uninterrupted, error-free, or secure operation and may modify or discontinue the Service at any time.

9. Warranties

The Service is provided “as is” and “as available.” Fit Pulse disclaims all warranties, including merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability.

10. Liability

Fit Pulse is not liable for indirect, incidental, special, consequential, or punitive damages arising from use of the Service. Total liability for all claims is capped at USD $100.

11. Indemnification

Users agree to indemnify Fit Pulse against claims arising from their use of the Service, violation of these Terms, or infringement of third-party rights.

12. Third Parties

The Service may integrate third-party services, including authentication and advertising. Fit Pulse is not responsible for third-party content, policies, or practices.

13. Termination

Users may terminate their account by contacting fitpulsegymtracker@gmail.com. User content is deleted within thirty days of termination, unless required by law. Fit Pulse may suspend or terminate access for violations.

14. Modifications

Fit Pulse may revise these Terms. Continued use after changes constitutes acceptance. The “Last updated” date indicates the most recent revision.

15. Governing Law

These Terms are governed by the laws of Fit Pulse’s jurisdiction. Disputes will first be addressed through informal negotiation. If any provision is unenforceable, the remainder remains valid.

16. Entire Agreement

These Terms, together with the Privacy Policy and Disclaimer, constitute the entire agreement regarding the Service.
